Show Me State Roll Offs, LLC — Rental Terms & Conditions

These Rental Terms & Conditions (the “Terms”) govern all roll‑off dumpster rentals and related services provided by Show Me State Roll Offs, LLC (“Company,” “we,” “us,” or “our”) to any customer (“Customer,” “you,” or “your”). By placing an order, taking delivery, or using our equipment/services, you agree to these Terms.


1) Service Area & Scheduling

  • We serve the Kansas City metro and surrounding areas. Service availability may vary by location.

  • Delivery and pickup windows are estimates. Weather, traffic, site conditions, or landfill delays can affect timing.

  • Same‑day/next‑day service is not guaranteed; we’ll do our best to accommodate your request.

  • We may require someone on site at delivery for placement confirmation; absent that, our driver will use best judgment.

2) Rental Term & Standard Inclusions

  • Standard rental includes [__] days and [__] tons of disposal per container, unless stated otherwise on your order or invoice.

  • Additional days beyond the included term are $[__] per day (or part of a day).

  • Disposal over the included tonnage is $[__] per ton (pro‑rated to the nearest 0.10 ton) plus any landfill surcharges.

3) Placement, Access & Site Conditions

  • Customer grants Company permission to enter the property and place/pick up the container at the designated spot.

  • Clearances required: approx. 60 ft of straight approach, 12 ft width, and 23 ft vertical clearance (no low wires/branches).

  • Customer is responsible for:

    • Ensuring the site is safe, level, and capable of supporting the weight of trucks/containers.

    • Marking utility lines, septic systems, sprinkler heads, and any underground/overhead hazards.

    • Obtaining permits for street or right‑of‑way placement when required and paying any associated fees/fines.

  • Driveway/Surface Waiver: Heavy trucks may crack or damage asphalt, concrete, turf, pavers, curbs, and sidewalks. Customer assumes all risk and releases Company from surface damage claims resulting from delivery, placement, or pickup.

4) Loading Rules & Safety

  • Fill Level: Do not load above the container’s top rail; load must be level with nothing protruding.

  • Weight Limits: Customer is responsible if load exceeds legal/posted weight limits. Overweight loads may require off‑loading at your expense.

  • Heavy Materials: Dirt, rock, concrete, brick, roofing tear‑off, and other dense debris may only be loaded to the halfway mark (or smaller container) at driver’s discretion.

  • No Relocating: Do not move the container once placed. Call us if relocation is needed (fees apply).

  • No Burning/Hot Loads: Ashes, smoldering, or hot materials are prohibited.

5) Prohibited or Restricted Materials

The following cannot be placed in the container unless specifically approved in writing and handled per law:

  • Hazardous/regulated waste: liquids, solvents, paints (unless fully dried), oils, fuels, chemicals, pesticides, asbestos, medical/biohazard waste, sharps, fluorescent bulbs/ballasts containing mercury, radioactive materials.

  • Electronics/Universal waste (where prohibited): TVs/CRTs, computer monitors, batteries.

  • Appliances with refrigerants (e.g., refrigerators, AC units) unless certified refrigerant removal paperwork is provided.

  • Tires (whole or shredded), mattresses/box springs, and large items may be accepted for an extra fee.

Contamination & Sorting Fees: If prohibited items are found or a load is rejected by a landfill/transfer station, Customer is responsible for all related charges, return trips, cleanup, and an administrative fee of [__]% (or $[__] minimum).

6) Fees & Charges (Summary)

  • Dry‑run/Failed Service: $[__] per trip when we cannot deliver/pick up due to blocked access, overloaded container, above‑rail debris, locked gates, unsafe site, or missing permits.

  • Wait Time: $[] per 15 minutes after first **[] minutes** on site.

  • Container Relocation on Site: $[__] per move (same property) if safe and feasible.

  • Emergency/After‑hours Service: $[__].

  • Cleaning/Spill Remediation: Time and materials, $[__]/hr plus supplies and disposal.

  • Admin/Processing: Up to [__]% on pass‑through fees (landfill surcharges, special handling, etc.), where permitted by law.

A detailed fee schedule may appear on your order/invoice and is incorporated into these Terms.

7) Permits, Fines & Compliance

  • Customer is responsible for permits and any fines for improper placement/use (including municipal right‑of‑way rules).

  • Customer agrees to comply with all applicable laws, weight restrictions, and disposal regulations.

8) Title to Equipment; Risk of Loss

  • Containers and related equipment remain Company property at all times.

  • Customer assumes responsibility for loss, theft, fire, vandalism, or damage to the container while on site, normal wear excepted.

9) Payment Terms & Card Authorization

  • Unless otherwise stated in writing, payment is due at booking. A valid credit/debit card is required and kept on file.

  • Customer authorizes Company to charge the card on file for all amounts due, including overages, extra days, trip fees, contamination, and taxes/fees when incurred.

  • Returned/declined payments may incur a $[__] fee. Late balances may accrue a late fee/finance charge as allowed by law.

  • Customer is responsible for all collection costs, including reasonable attorney’s fees, court costs, and lien rights where applicable.

10) Cancellations, Changes & Refunds

  • Standard cancellations: Notify us by [3:00 PM previous business day] to avoid a $[__] cancellation fee.

  • On‑route cancellations or refused deliveries may be treated as a dry‑run.

  • Refunds (if any) are issued at Company’s discretion and may exclude delivery or other sunk costs.

11) Missed Pickups & Abandonment

  • If pickup is requested and the container is blocked/unsafe/overfilled, applicable fees will apply. Rental time continues until a successful pickup occurs.

  • If Customer fails to request pickup within [__] days after the rental term, Company may retrieve the container and bill for all accrued charges.

12) Photographs & Evidence

  • Company may photograph the container/site (delivery, during rental, and pickup) to document placement, load level, and condition.

13) Limited Warranty; Disclaimer

  • Services are provided “as is” without warranties of any kind, express or implied. We disclaim implied warranties of merchantability and fitness to the extent permitted by law.

14) Limitation of Liability

  • To the fullest extent permitted by law, Company’s total liability for any claim arising out of or relating to the rental/services is limited to the amounts you paid for the specific container/service at issue.

  • We are not liable for consequential, incidental, special, exemplary, or punitive damages (including lost profits, business interruption, or property damage to surfaces/underground utilities).

15) Indemnification

  • Customer agrees to defend, indemnify, and hold harmless Company and its owners, employees, and drivers from all claims, damages, fines, and expenses arising out of (i) Customer’s breach of these Terms, (ii) site conditions, placement instructions, or access provided by Customer, and (iii) contents of the container and disposal of such contents.

16) Force Majeure

  • Company is not responsible for delays or failure to perform due to events beyond our reasonable control, including weather, disasters, labor issues, supply chain disruptions, and governmental actions.

17) Dispute Resolution; Governing Law

  • Good‑faith negotiation first. If unresolved within 30 days, disputes will be resolved in small claims court or by binding arbitration (at Company’s election) on an individual basis, not as a class, under the rules of a recognized arbitral forum.

  • These Terms are governed by the laws of the State of Missouri. Venue lies in Jackson County, Missouri, unless arbitration is elected.

18) Changes to Terms

  • We may update these Terms at any time. The version in effect at the time of your order applies to that order.
